KissAsians – Asian Dramas & Movies with English Subtitles respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), the text of which may be found on the U.S. Copyright Office website atcopyright.gov, we will respond expeditiously to claims of copyright infringement that are reported to the designated agent identified below.

1. We do not host any content

KissAsians – Asian Dramas & Movies with English Subtitles is an indexing service. We do not host, upload, store, record or stream any video files, media or copyrighted material on our servers. All media is hosted by third-party services that are not owned by, operated by, controlled by, or affiliated with KissAsians – Asian Dramas & Movies with English Subtitles. Pages on this site contain only links to, and embeds of, material hosted elsewhere.

If you believe your copyrighted work has been made available in a way that constitutes infringement, pleasealso contact the site actually hosting the file, as removing the source is the only way to make the material permanently unavailable. On receipt of a valid notice we will remove the offending link or embed from our index.

2. Filing a notice of infringement

To file a notice of claimed infringement, please send a written communication to our designated agent (see contact details below) that includes substantially the following (please consult your legal counsel or refer to 17 U.S.C. § 512(c)(3) to confirm these requirements):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material — this means providing the full URL(s) of the page(s) on this website where the material appears.
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under 17 U.S.C. § 512(f) you may be liable for damages, including costs and attorneys’ fees, if you knowingly materially misrepresent that material or activity is infringing.

Notices that do not include the information described in Section 2 may not be actionable. We aim to process valid, complete notices within a few business days.

4. Counter-notification

If you believe that material you posted or linked was removed or disabled by mistake or misidentification, you may send a written counter-notification to the contact above that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notification we may restore the removed material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5. Repeat infringers

In appropriate circumstances and at our discretion, KissAsians – Asian Dramas & Movies with English Subtitles will disable and/or terminate the accounts of users who are found to be repeat infringers, and will remove and refuse to restore content that is the subject of repeated valid notices.

6. Changes to this policy

We may update this DMCA policy from time to time. The version published on this page is the version currently in effect.
